When do I need a permit for scaffolding? On Public Land: Anytime scaffolding encroaches onto public land, such as a footpath, road, or verge, a licence is mandatory for public safety. Private property: You do not need a permit e.g. a garden/drive or within the property boundary. Permits are arranged through the Local Authority; in Leicester we apply for these on your behalf, in other counties the rules can be different.
